The scientific debate on Crisis and Insolvency Law is enriched by a new, fundamental milestone. On June 26 and 27, the Aula Magna of the Court of Appeal at the Court of Bari will host the traditional annual event organized by the Chamber of Insolvency Procedures of Bari, under the prestigious scientific coordination of the OCI (Observatory on Business Crises).
This high-profile event sees Gobid Group participating at the forefront, confirming its role as a strategic partner and point of reference for industry professionals and procedure bodies.
The Focus of the Debate: Balancing Turnaround and Creditor Protection
While it is true that the Crisis and Insolvency Code places central focus on safeguarding the entrepreneurial fabric and consumer access to debt discharge instruments, no procedure has a reason to exist unless it aims to satisfy creditors. Distribution criteria, by protecting the creditor’s interest, guarantee the sustainability and very effectiveness of the solutions provided for the debtor.
In this renewed perspective, the conference titled “Distribution Criteria with a Look at Allotment in Insolvency Procedures” will analyze the current relevance of the code principles of liability and par condicio creditorum through a synergistic comparison between leading experts from the judiciary, academia, and professional sectors.
Guidelines of the Debate: The Evolution of Application Practices
The Bari assembly was conceived with the intent of taking stock of the regulatory state of the art, offering professionals a clear and operational framework on the most complex dynamics of insolvency management. The focus of the proceedings will develop around five strategic macro-themes:
- Procedural Dynamics and Supervisory Powers: The analysis will focus on the delicate phases of opening, managing, and closing proceedings, mapping the extent of the Courts’ powers, the activities of the Delegated Judges, and the crucial role assumed by the Crisis Composition Bodies (OCC).
- Professional Liability Profiles: The functions of advisors and the professionals involved will be examined in detail, with a targeted focus on mandatory information flows, proper certification and preparation of plans, and the relative civil and professional implications.
- Jurisprudential Trends and Interpretative Knots: Space will be given to examining the main application uncertainties that emerged in the practice of the Courts and the Supreme Court of Cassation, with particular attention to the verification of eligibility requirements, the scrutiny of the debtor’s worthiness, and the practical implications of debt discharge.
- Credit Protection in Minor Procedures: A specific in-depth study will be dedicated to creditor protections within minor proceedings, analyzing the rules for compiling the statement of liabilities, safeguarding priority rights, the fate of pending contracts, and the concrete satisfaction mechanisms for creditors.
- Operational Uniformity: The ultimate goal remains the creation of a platform for direct comparison between professionals and the judiciary, aimed at outlining shared interpretations and promoting office practices that are as homogeneous, efficient, and predictable as possible.
