Legislative Developments: Key Topics of the Debate
The morning session, introduced by Stefania Armiero, advisor of the Naples Bar Association, offered valuable insights into several timely issues: the evolving case law on judicial banking titles, the consistency of final judgments, and the role of the enforcement judge. A significant portion was also dedicated to analyzing out-of-court banking titles, with a particular focus on active ownership, regulatory aspects, debtor protection, and contractual clauses. The morning concluded with an in-depth analysis of the distribution of bank credit, addressing long-standing issues and emerging concerns.
Erika Capobianco, Secretary of the Enforcement Commission of the CNDCEC, moderated the afternoon session. The discussion shifted to the role of the court-appointed custodian, their duties and responsibilities in managing seized assets, and the regulatory developments concerning the delegation phase, with particular attention to the controls and obligations of the Appointed Professional.
